A client wished to purchase a leasehold property located in Charles Haller Street, London Borough of Lambeth, for £ 250,000. On 26th March, 2007, the client instructed the Phew! Conveyancing team to inspect the said property and instruct him regarding the same. It was also instructed to ensure that the property was occupied only by the seller or his immediate family and no one else.
It was found that a few rights existed on the property. It was also subject to a few covenants; a full list of these is to be found in the schedule of restrictive covenants. While it was stated that the certificate provided by the Solicitor of Brockwell Gate Management Company Limited mentioned that the transfer was not in contravention of the provisions provided in the Clause 14 of the registered lease, it was not provided at the time of inspection.
A local search authority stated that there was a Tree Preservation order in the area. Under the TPO specific trees were protected from damage and destruction. There was also a smoke control order, which means that the property was subject to the Clean Air Act and hence burning of unauthorised fuel was prohited.
The locality is not maintained at public expenses, but is maintained privately. At the time of the inspection, there were no new roads planned within 200 metres of the property.
