On 27th June, 2008, the conveyancing team at Phew! was advised by a client to assist in the purchase of a leasehold residential property located in Leigham Court Road, London Borough of Lambeth. The property purchased by the client for £ 174,000 was guaranteed to be of absolute title and hence assured of ownership by the Registry.
The conveyancing team was instructed to observe if the property was indeed occupied by the seller and his immediate family. It was observed that there was a Smoke Control Order on the property and hence the property was subject to the Clean Air Act. The use of any unauthorised fuel to create smoke was prohibited. For a list of authorised fuels, the client was advised to refer to the Solid Fuel Association website.
As for the planning permission for the property was concerned, it was found that it was under a conservation area. This means that there are strict guidelines with respect to it preservation and enhancement. The owner was also allowed to cut trees provided that the owner had to give a six week notice to the local authority.
Since the area was adopted, it was found that Leigham Court Road was maintained at public expenses. At the time of inspection, it was noted that there were no plans for road improvement or construction of new road at the time of inspection. Conveyancing lawyers for the sellers were M/s.
