On 24thApril 2007, a client instructed a Phew! Conveyancing solicitor to assist in the purchase of a property located on Quicks Road, London. The property was bought by the client for £ 435000. The London Borough of Merton was related to this conveyancing deal.
The conveyancing solicitor examined the office copy entries at the land registry. The property was leasehold and the title absolute which alleviated concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
Some additional restrictive covenants were registered against the property which was mentioned in the Restrictive Covenants under freehold title dated, 8th June 1888 which were not supplied on first registration. The plan of the leasehold title was produced according to which the yellow tinted part represented the portion including the ground, first and second floor, the pink tinted part represented the portion including the first and the second floor whereas the blue tinted part represented the portion including the first floor only.
The Phew! Conveyancing Solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well. It was also revealed that Quicks Road is adopted and maintained by the London Borough of Merton. Our Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads.
