On 13th October 2011, a client instructed Phew! Highbury Conveyancing solicitor to assist in the purchase of a property located at Lucerne Road, Highbury, London. The property was bought by the client for £ 385000. The London Borough of Barnet was related to this conveyancing deal.
The conveyancing team carefully inspected the office copy entries and found that the property was Leasehold. The conveyancing team also assured the property to be solely occupied by the owner and his immediate family members.
According to Conveyance dated 26th September 1957, additional restrictive covenants were registered against the property as mentioned in office copy entries of the property. They contained restrictive covenants that the client must abide, failure to do so might pave way for legal consequences.
Some additional restrictive covenants that must be followed are:
- The owner of the property must not involve in activities that can lead to any kind of harm or distress to the neighbours or be a public nuisance.
- The property must be used for private residential purposes only and no such privileges must be acquired or established over the neighbouring property.
The conveyancing team also revealed that the property stood in an area which came under the purview of Smoke Control Order and Clean air Act. As per Smoke Control Order, smoke from chimney was not allowed and the Clean air Act did not even allow smoke of any kind from other premises, as well.
There was an HMO order on the property which meant that the client must inform the London Borough of Barnet if the property was to be occupied by more than one household as bed-sitting rooms or other non self-contained accommodation. The client must also need a licence from the London Borough of Barnet before letting the property as HMO. Failure in doing so may result in fines, criminal conviction and other penalties.
The property is part of a Conservation Area as it was designated by the local planning authority as one with special architectural or historic interest. There are certain formalities for demolition of buildings, advertisements and other issues within a conservation area. Consent must be obtained for any demolition. To work on trees within a Conservation Area a landowner needs to give a six week notice to the Borough of Barnet.
Lucerne Road is adopted & is maintained by London Borough of Barnet. Our Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads.
