On 24th September 2007, a client instructed a Phew! Hillfield Avenue Conveyancing solicitor to assist in the purchase of a property located at Medici Court, Hillfield Avenue, London. The property was bought by the client for £ 345000. The London Borough of Haringey was related to this conveyancing deal.
The conveyancing solicitor carefully inspected the office copy entries and found that the property was Leasehold. The conveyancing solicitor also assured that the property was solely occupied by owner or his immediate family members before the sale.
Apart from what was mentioned in the lease, additional rights passing with the property were:
- The access to common areas within the premises.
- The permission to use the dustbin area, coloured purple in the plan and also access to parking space numbered 1 and delineated brown in the plan to park only 1 vehicle not exceeding 15 feet in length.
The additional rights over the property were listed in the lease. The additional restrictive covenants registered against the property were the covenants that were outlined under the clauses 3 and 4 starting from page 14 of the lease. The covenants mentioned must be strictly adhered throughout the ownership of the property or else may result in severe consequences.
The conveyancing solicitor also revealed that the property stood in an area which came under the purview of Smoke Control Order and Clean air Act. As per Smoke Control Order, smoke from chimney was not allowed and the Clean air Act did not even allow smoke of any kind from other premises, as well.
Medici Court is adopted & hence maintained by London Borough of Haringey. However, contribution has to be made towards development of internal roadways. A planning permission was granted in 2006 for works on trees in the property. The Phew! conveyancing solicitor made a request to the seller’s solicitors for further details about the same. Our Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of existing roads.
