On 23rd January 2007 a client hired the Phew! Conveyancing team for providing assistance in purchasing a property situated in Landseer Close, Merton Abbey, London. The client bought the property for £ 190000. London Borough of Merton was the local authority associated with the conveyancing deal.
The Phew! conveyancing solicitor examined the office copy entries at the land registry. The property was freehold and the title absolute which alleviated concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
Along with those mentioned in the lease, there were some extra rights passing with and over the property. The rights included right to air, light and drain which were mentioned in the transfer dated 21st April 1983. There were also some additional restrictive covenants registered against the property. These were mentioned in the charges register and the residential property was not allowed to be used in any other way than as a dwelling.
The Phew! Conveyancing Solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well.
Planning permission was granted for 224 houses, flats and maisonettes along with 16 garages.
The Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads. The Conveyancing team realised that any proposal from the local authority may affect the value of property and inquires were made to keep the client in a safer zone. The surveyor was also contacted for more details. A matter of concern was that the property stood in an area which was affected by radon gas and the same was intimated to the client. Thornburn Avenue and Landseer Close were adopted but not the rear Accessway which meant that the client had to contribute towards its maintenance work.
