On 22nd January 2007, a client instructed a Phew! Conveyancing solicitor to assist in the purchase of a property located on Cator Road, London. The property was sold for £ 400000 to the client. London Borough of Bromley was the local authority associated with the conveyancing deal.
The conveyancing team examined the office copy entries at the land registry. The property was freehold and the title absolute which alleviated concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
Some additional restrictive covenants were registered against the property whose details were mentioned in the Conveyance dated 10th July 1939. They were outlined in the Schedule of Restrictive Covenants in the Office Copy Entries. The conveyancing team also instructed the client to abide by the restrictive covenants mentioned in the Conveyance dated 10th July 2007. Any failure by the client to do so may lead to possible legal consequences.
The Phew! Conveyancing team’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well. There were neither any proposals nor any plans for improvement of existing roads or the development of new ones in the near future.
