The buyer’s conveyancing solicitor normally prefers to draft the transfer deed, but sometimes the seller may reserve the right to do so through an obligation enforced by the contract. This is usually done when the contract involves the sale of new house where the seller supplies an engrossment of the transfer.
The transfer deed is usually prepared immediately after exchange of documents and sent to the seller’s conveyancing solicitor for his approval. Under Standard Conditions 4.3.2, the draft of the transfer deed should be provided to the seller for his approval at least twelve working days before completion of contract. According to the protocol, the buyer’s conveyancing solicitor is required to submit draft transfer deed to seller’s conveyancing solicitor when he approves the draft contract before the exchange of contracts.
