Leasehold Property Conveyancing, Leathwaite Road, Battersea, Wandsworth

On 14th September 2010, a client wanted the assistance of the Phew conveyance team in  20purchasing a property located on Leathwaite Road, Battersea, London. The property was bought by the client for £ 386000. The local authority associated with the sale was the London Borough of Wandsworth.

The office copy entries were verified by the team and the property was found to be freehold. The property held an absolute title which eliminated fears regarding ownership as it was guaranteed by the registry. The team also ensured that the owner and his family members were the sole occupants of the property before the sale.

The additional rights over the property were as mentioned in the Conveyance dated 22nd February 1982.  There were some additional restrictive covenants that were registered against the property. Any sort of business activity involving the use of liquor or its products must not be carried in the property. Further covenants have been mentioned in a conveyance dated 22nd February 1982.

The conveyancing team also found that the property stood in an area which came under the Smoke Control Order and Clean air Act. According to the Smoke Control Order, excess smoke from chimney was not allowed to be disposed into the environment and according to the Clean Air Act smoke of any kind from other premises was not allowed.

There was an HMO order according to which the London Borough of Wandsworth must be informed, if the property was occupied by more than one family as bed or sitting rooms or any other non self-contained accommodation with sharing facilities. A licence from the London Borough of Wandsworth was required before the property is let as a HMO. Any failure to obey the rule might pave way for legal action.

Leathwaite Road is adopted & maintained by the London Borough of Wandsworth. Our conveyancing solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of existing roads.
