The Phew! Conveyancing team was instructed on 17th November 2007, by a client to advise the purchase of a leasehold residential property located in Loughborough Park, London Borough of Lambeth. The seller sold the property for £ 173,000 to the client.The conveyancing team was also instructed by the client to make sure that the property was occupied only by the seller or his immediate family members.
It was mentioned that the property had an absolute title and hence ownership was guaranteed by the Registry. A search of the Official Copy Entries revealed that the freehold title shall possess all the covenants associated with the title and hence shall require the landlord to be aware of them. The other leases associated with the property have been identified in the Schedule of Leases under the umbrella, leases.
A search at the Local authority revealed that there was a Smoke control order in the area surrounding the building. This means that the area shall be governed by the Clean Air Act and hence use of unauthorised fuel shall not be allowed. A complete list of authorised fuels can be found from the Solid Fuel Association website and the client was advised to check the same.
It was also found that Loughborough was an adopted area and hence was maintained by the local council at public expenses. There were no proposals or plans for any road improvement projects in the locality during the time of inspection. The conveyancing for the sellers was done by M/s. Shoosmiths and estate agents for the seller were M/s. Spicehart.
