On 27th February, 2007, the Phew! Conveyancing Team was instructed by a client to oversee the purchase of a leasehold residential property located in Farm Avenue, London Borough of Lambeth. The conveyancing team was informed that the land was registered with an absolute title and hence ownership was guaranteed by the Registry.
An inspection of the Office Copy Entries found that the property had good leasehold title. Good leasehold title means that the property shall be subject to all adverse interests that may exist at the time of registration. Since the lease cannot be validly granted, the conveyancing team was also asked to check if it is only occupied by the seller and none else.
A search at the Local Authority found that there was a Smoke Control Order on the property and was hence subject to the regulations provided under the Clean Air Act. Thus, it was advised that the client shall not be able to use any unauthorised fuel.
It was also found that Farm Avenue was adopted and hence was maintained by the local council at public expenses. It was also found that there were no plans for road improvements or laying new roads within 200 metres of the property.
