On the 15th of January, 2008, the Phew! Conveyancing team was instructed by a client to inspect and advise the purchase of a property situated in Tivoli Road, London Borough of Lambeth. The freehold property was ultimately purchased for £249995 by the client. An examination of the Office Copy Entries revealed that there was absolute title to the property, and hence ownership was guaranteed by the Registry.
After referring to the Clause 1 in the Charges Register, it was found that as per the transfer dated 15th September, 2003, restrictive covenants were imposed on the property. The client had instructed to find out whether any right is passing with the property and conditions that were attached with regard to the use of the property.
A local authority search revealed that there was a Smoke Control Order on the property. Smoke caused by unauthorised fuel was prohibited under the Clean Air Act, and the client was instructed to install a modern Heating appliance that uses smokeless fuel.
It was also observed that the property in Tivoli Road was maintained by the local council at public expenses. As for plans or proposals to lay new roads or undertake road improvements, it was found at the time of inspection that, there were no proposals to construct new roads, or road improvement within 200 metres of the property.
The Estate agent for the transaction was Spicerhaart, and the conveyancing solicitor for the seller was Landau Zeffertt Weir Solicitors. The details were sought by the conveyancing team from the Council at the London Borough of Lambeth.
