Purchase of Freehold Property located in Abercairn Road, Lambeth

The Phew! Conveyancing team was instructed on 22nd of June, 2007 to inspect purchase of a freehold residential property located in Abercairn Road, London Borough of Lambeth by a client. The team was asked by the client to make sure that the property was occupied only by the seller and his immediate family.

An inspection of the official copy entry revealed that additional covenants were registered with the property, wherein the prospective buyer could not erect any public house, flat or garage on any part of the land, neither can he trade or engage in any business. But professionals such as solicitors, doctors, dentists etc. are exempted from the second restriction. The prospective buyer may also, not place a shed, caravan, swing or any other roundabout or any advertisement on the land. He is also required to maintain a boundary of a quick wall or a closely boarded fence almost five feet in height.

An enquiry with the local planning authority at the local council revealed that there was a smoke control order on the property at the time of inspection. This meant that the area surrounding the premises was covered under the Clean Air Act and the use of unauthorised fuel was prohibited.

It was also found that Abercairn Road was adopted and maintained by the local council at public expenses. At the time of inspection, there were no proposals for road improvements or new roads within 200 metres of the premises.

With respect to the inspection of passing rights on the property, it was found that these details were contained in the transfer dated 9th May, 2003, and the details were requested from the seller’s solicitors, viz. Campbell Hooper. The Estate agent for the conveyancing transaction was Spicehaart.
