On 1st September 2006, a client instructed a Phew! Conveyancing solicitor to assist in the purchase of a property located on Freshwater Road, London. The property was bought by the client for £ 275000. The London Borough of Wandsworth was related to this conveyancing deal.
The conveyancing solicitor examined the office copy entries at the land registry. The property was freehold and the title absolute which alleviated concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
The land registry documentation revealed that the property was subject to a transfer dated 30th April 1984. According to this transfer, the client enjoyed a set of rights and benefits, apart from whatever is mentioned in the lease. Some additional restrictive covenants were registered against the property which was mentioned in the Restrictive Covenants from TR1 of 30th April 1984.
There is a change in the name of the registered proprietor after marriage which could be easily sorted out as the marriage certificate is available. The conveyancing solicitor enlightened the client to abide by the restrictive covenants mentioned in the conveyance dated 30th April 1984, failure of which may lead to legal actions.
The Phew! Conveyancing Solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well. Our Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads. Approval for building a W.C on the first floor was received. Also, a request for the document of approval was made to the seller’s solicitor. An approved permission from the authority could be made for further developments.
