Freehold Property (Residential) Conveyancing, Berberis Walk, London Borough of Hillingdon

On 19th December 2007, a Phew! Conveyancing solicitor was instructed by a client to assist in purchase of a property located on Berberis Walk, London. The property was bought for £ 250000 by the client. London Borough of Hillingdon was the local authority concerned with the conveyancing deal.

The conveyancing solicitor examined the official copy entries at the local registry & found that the concerned property was freehold. The title was registered as absolute. Thus, worries concerning ownership of the property were alleviated as the registry guaranteed it. The conveyancing solicitor also confirmed that the property prior to sale was occupied by the seller or his immediate family. The Land Registry documentation revealed that the property was subject to a transfer dated 16th January 1984.

According to this transfer, some additional rights were passing along with the property. The client can use the blue coloured passage way on the plan as per the transfer. As per the second schedule, the rights which the property benefits from are also confirmed. There were also certain additional restrictive covenants registered against the property as per the Third schedule of the transfer. The client must adhere to these covenants throughout the ownership period.

The local authority search information indicated that the property as under the purview of the Smoke Control Order. As per this order, smoke from the chimneys was regarded as illegal. Another restriction here was the Clean air Act and according to this, even smoke from other premises was proscribed.  It was also revealed that Berberis Walk is adopted and maintained by the London Borough of Hillingdon.

Our conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads. Besides that, the information of relevance was that a planning permission for a single storey near extension was granted in 1994. The Conveyancing team requested for the related copy from the seller’s lawyer.
