On 4th February 2009, a client instructed a Phew! Barnet Conveyancing solicitor to assist in the purchase of a property located on Milton Avenue, London. The property was bought by the client for £ 492000. The London Borough of Barnet was related to this conveyancing deal.
The Phew! Conveyancing solicitor carefully inspected the office copy entries and found that the property was Freehold. Some restrictive covenants were registered against the property. They were sketched in the schedule of restrictive covenants in the office copy entries.
The Phew! Conveyancing solicitor also found that there were some additional rights passing with and over the property. The land has the benefit of a right of way over the area of the passage at the side. Also the area of the passage at the side is included in title subject to the right of way. Also there were some additional restrictive covenants registered against the property. Any kind of erection or projection that obstructs light, air or view of the vendor’s estate from neighbouring houses was prohibited. The property shall be used only as a private dwelling house. However, only professionals like Dental Surgeon, Registered Medical Practitioner, Surveyor or Solicitor are allowed to stay in the property. The boundary wall towards the south west side of the property must be maintained as given in the schedule of restrictive covenants. It was also found that the property does not have the right of access of light or air over the surrounding properties.
The Phew! Conveyancing solicitor also revealed that the property stood in an area which came under purview of Smoke Control Order and Clean air Act. As per Smoke Control Order, smoke from chimney was not allowed and the clean air Act did not even allow smoke of any kind from other premises, as well. Also, there was an HMO order which meant that you must inform the council if the property was occupied by more than one household as bed-sitting rooms or other non self-contained accommodation with sharing amenities. You must need a licence from the London Borough of Barnet before you let the property as HMO. You must contact the London Borough of Barnet for more information if you want to let the property as HMO. Failure in doing so might result in fines, criminal conviction and various penalties.
Milton Avenue is adopted and so it is maintained by London Borough of Barnet. The Phew! Conveyancing solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads. It was also found that the London Borough of Barnet is introducing traffic calming measures and controlled parking zones.
