On 21st September, 2010 the Phew! Conveyancing team was hired to instruct a client for purchasing a leasehold property for a sum of £ 153,000. The property was located on Old Road, London and the local authority associated with the conveyancing deal was London Borough of Enfield.
On reviewing the official copy entries, it was found that the property was registered with the absolute title which meant that the ownership is guaranteed by the Registry.
The Phew! Conveyancing solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke control Order and Clean Air Act. According to the smoke control order, smoke from chimneys is to be prohibited. The Clean Air Act prohibited smoke from other premises as well. It is to be noted that Smoke control order do not apply to domestic bonfires.
The Phew! conveyancing team also revealed that a HMO order existed on the property. According to the HMO order, you must inform the London Borough of Enfield if the property will be occupied by more than one household with sharing of bathrooms and toilets. The client would require a licence from the London Borough of Enfield before letting the property as HMO. Failure to do so may result in conviction & penalties for the client. It was also revealed that Old Road is adopted, and it is maintained by the London Borough of Enfield. There are no proposals/plans for road improvements or new roads within 200 metres of the property.
