On 26th June, 2007, a client asked the Phew! Conveyancing team to inspect and instruct the purchase of a leasehold property located in Palace Road, London Borough of Lambeth. The client purchased the property for £211,000 and had instructed the conveyancing team to inspect if the property was indeed occupied by the seller or his immediate family before the purchase.
A local authority search revealed that the title of the property was absolute and hence ownership was guaranteed by the Registry. There existed a Smoke Control Order, which meant that the property was controlled by the Clean Air Act and the use of any unauthorised fuel was strictly prohibited.
The client was also asked to refer to the Solid Fuel Association website to get a complete list of authorised fuels.
It was also found that the Palace Road area was adopted and hence maintained by the local council at public expenses. There were also no proposals for road improvement or extension within 200 metres of the property at the time of inspection.
