The Phew! Conveyancing Team was instructed by a client to inspect a property situated in Pentney Road, London Borough of Lambeth. The property was purchased for £665000 by the client. The conveyancing team was also asked to check whether the property was indeed occupied only by the seller or his immediate family members.
It was found by the team that the property was subject to a conveyance, dated 30th of June 1972. The conveyancing team was also asked to check if there was any restriction, especially one which mentioned that the owners cannot carry any trade or business and whether the property was used as a private dwelling.
An Information Search at the Local authority revealed that there was an HMO order on the property, which meant that no more than one family can be allowed in the property. A licence is needed before the property could be let out. There also existed a Smoke Control Order, which means that the use of unauthorised fuel was prohibited under the Clean Air Act.
It was also mentioned that the area surrounding the property was adopted, and hence maintained by the local council at public expenses. Also, there was no proposal or plan to construct new roads, or extension of existing roads within 200 metres of the property.
The conveyancing team for the seller was Hodgsons and Mortimer, and Estate agent for the transaction was Marsh and Parsons. Various Searches were done at the local council of the London Borough of Lambeth.
