On 16th December 2009, a client instructed a Phew! Collindale Conveyancing solicitor to assist in the purchase of a property located at Penylan Place, Colindale, London. The property was bought by the client for £ 310000. The London Borough of Harrow was related to this Conveyancing deal.

The conveyancing solicitor carefully inspected the office copy entries and found that the property was Freehold. The conveyancing solicitor also assured that the property was solely occupied by the owner or his immediate family members before the sale.

There were some additional rights passing with the property:

  1. The clear access to roadways coloured Brown in the title plan.
  2. The access to service installations in neighbouring properties and those which came under the road for personal benefit of the property. For more details the Property Register of OCE could be referred.

There were also some additional rights over the property:

  1. Complete access was granted to access way for purpose of repairing service installations in adjacent properties.
  2. Further details have been mentioned in the Property Register of OCE, which could be referred.

There were some additional restrictive covenants registered against the property as well:

  1. The access to entry A to C and entry E as mentioned in plan, as per Third Schedule in OCE, which imposes certain rules and regulations that need to be followed in case of new construction or alteration.
  2. The property must be used as private dwelling house or as a professional residence for private use only. Further details have been mentioned in the charges register of the property, which could be referred in any case.

The conveyancing solicitor also revealed that the property stood in an area which came under the purview of Smoke Control Order and Clean air Act. As per Smoke Control Order, smoke from chimney was not allowed and the Clean air Act did not even allow smoke of any kind from other premises, as well.

There was an HMO order on the property which meant that the client must inform the London Borough of Harrow if the property was to be occupied by more than one household as bed-sitting rooms or other non self-contained accommodation. The client must also need a licence from the London Borough of Harrow before letting the property as HMO. Failure in doing so may result in fines, criminal conviction and other penalties.

Penylan Place is adopted & is maintained by London Borough of Harrow. Our Conveyancing Solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of existing roads.
