Although the conveyancing solicitor is not under an obligation by the law to carry out such an inspection in every transaction, the conveyancer should do it if the client asks for one, or if issues reported to the client indicate the need to carry out such an inspection. The client should be asked to look for and report back to solicitor about the existence of any of the following matters:
a) Discrepancy or uncertainty with respect to the identity of or boundaries of the property.
b) Evidence of the existence of easements that may adversely affect the property.
c) The existence and the status of non owning occupiers, and
d) A discrepancy in fittings and fixtures that the client understands to belong to the property, and those that actually belong to the property.
