Residential Property (Freehold Conveyancing), Ladysmith Road, London Borough of Enfield

On 17th July 2006, a client instructed a Phew! Conveyancing solicitor to assist in the purchase of a property located on Ladysmith Road, London. The property was bought by the client for £ 365000. The London Borough of Enfield was related to this conveyancing deal.

The conveyancing solicitor examined the office copy entries at the land registry. The property was freehold and the title absolute which alleviated  concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.

There were some additional restrictive covenants registered against the property which was mentioned in a conveyance dated 2nd March 1931. They were also detailed in the official copy entries.

The Phew! Conveyancing Solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well. Our conveyancing solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads.

A conditional planning permission was granted for building a room on the roof which also included the construction of rear dormer. The permission for a single storey extension was granted on 6th July 1984. The conveyancing solicitor also received a copy of the planning permission from the seller’s solicitor. However, on 31st March 1988 a planning permission was refused for building a room on the roof of the house, including the installation of rear dormer and side. On 27th October 1988, an appeal against the refusal was dismissed.

The conveyancing solicitor for the seller was Vanderpump & Sykes and the Estate agent for the conveyancing deal was W.J.Meade.
