A client instructed a Phew! Conveyancing solicitor to assist in the purchase of a property located on Sutton Common Road, London. The property was bought by the client for £ 299950. The London Borough of Sutton was related to this conveyancing deal.
The conveyancing solicitor examined the office copy entries at the land registry. The property was freehold and the title absolute which alleviated concerns regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
There were additional rights which passed to the client along with the property. Even though it was not mentioned in the title, the client had right to access the passageway towards the side and also over the passageway which leads to Fairlands Avenue & St. John Road from the back. However, the client is required to make payment for the maintenance and repair works of the same. Also, there were restrictive covenants which were registered against the property and they were mentioned in the Official Copy Entries. The client must abide by these restrictions during possession of the property.
The Phew! Conveyancing Solicitor’s further enquiries revealed that the area where the house is situated was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clear Air Act prohibited smoke from other premises as well. It was also revealed that Sutton Common Road is adopted and maintained by the London Borough of Sutton. Our conveyancing solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of the existing roads.
