Leasehold Property, Macaulay Road, London Borough of Lambeth

On 15th September 2009, a client hired the Phew! Conveyancing team for guiding him in regard to purchase of a property situated in Macaulay Road, London. The seller sold the property for £ 305,000 to the client. The local authority related to the deal was London Borough of Lambeth.

All the official copy entries concerned were examined by the conveyancing team and it was revealed that the property was leasehold with absolute title. This indicates that ownership is guaranteed by the registry.

The Phew! Conveyancing team also found out that only the seller and his immediately family occupied the property prior to the sale. In addition to the conditions mentioned in the lease, there were some additional rights passing with the property.

Based on the local authority search information, it was found that the area where the property stood came under the Smoke Control Order as per which the smoke from chimneys was prohibited. The Clear Air Act restricted smoke from other premises also. HMO order passed over the area required that the concerned authorities must be informed is case the property or a part of it was intended to be shared. Any failure to do the same could lead to unpleasant legal consequences.

The property stood in a conservation area. This means the area was designated to be of historic or architectural interest by the Local Planning Authority. Thus special restrictions were imposed in regard to the building demolitions, cutting of trees etc.

Macaulay road was adopted and the council maintains it at public expense. There were not any plans or proposals for improvement of existing roads or new road arrivals.

The lawyer for the selling party was Darlingtons Solicitors and the Estate agent was James Pendleton Estate Agents.
