On 22th October 2007, a client hired the Phew! Conveyancing team for assistance in regard to purchase of a property located in Loughborough Road, London. The property was sold for £ 180,000 to the client. The local authority concerned with the deal was London Borough of Lambeth.
The conveyancing team examined the related official copy entries and found out that the property was leasehold and the title absolute which alleviated the concern regarding ownership. It was also made clear that the property was solely occupied by the seller and his immediate family.
There were some additional rights passing with and over the property apart from what is mentioned in the lease dated 6th August 1984. In addition to this, additional restrictive covenants were also registered against the property those which were mentioned in the lease and those referred to in the Charges Register.
The Phew! Conveyancing team upon further enquiry got intimated that the area where the property stood was subjected to Smoke Control Order and Clean air Act. According to the Smoke Control Order, smoke from chimneys is to be prohibited. The Clean Air Act prohibited smoke from other premises as well.
It was also revealed that Loughborough Road is not an adopted one and so it is not maintained by the local council. The client may have to contribute for the repair and maintenance works. Besides that, there were not any future plans regarding the arrival of new roads or maintenance of the existing roads.
Another relevant information was that the Loughborough Estate and the internal access ways at Elmore House were not adopted. So, the client may have to contribute to the maintenance works. The Phew conveyancing team also wrote to the seller’s solicitor to find out more details.
