A client was contemplating to purchase a residential leasehold property located in Park Hill, London Borough of Lambeth. The purchase price for the property was set at £480,000. On 28th April, 2010, the Phew! conveyancing team was instructed by the client to make sure that the property was indeed occupied by the seller or his immediate family members.
It was made known that the property was registered in the Land Register with an absolute title and hence ownership was guaranteed by the Registry.
A Local Authority Search report revealed that there was a Smoke Control Order in the area. Thus, the area surrounding the property was under the preview of the Clean Air Act and hence the use of any unauthorised fuel was prohibited.
There was an HMO order on the property at the time of inspection. Thus, the buyer would be obligated to inform the local council if the house is likely to be occupied by more than one family. Permission should be sought from the local council if the property is to be let out as HMO. Not adhering to these regulations would result in penalties including fine and even criminal conviction.
Park Hill area was adopted and hence maintained under public expenses. As for proposal for future extension of roads or construction of new roads, it was found that at the time of inspection that there were no such plans within 200 metres of the area of the property.
