On the 26th of October, 2007, a client instructed the Phew! Conveyancing team to assist in the purchase of a leasehold property situated in Wavertree Court, London Borough of Lambeth.The client asked the team to check whether the property was occupied only by the seller and his immediate family members. Official copy entries established that there was an absolute title to the property, which meant that the ownership of the property was guaranteed by the Registry.
It also mentioned rights that pass through the property including right to use on foot all corridors, landings, passages, and stairs in the building. A right to pass over the pathway to gain access to the property is also mentioned in the Register. Covenants affecting the property are also to be examined and instructed to the client.
Upon a search with the local authority it was found that was a Smoke control order on the property. This means that smoke from unauthorised fuel is prohibited under the Clean Air Act. It was also found that the Wavertree Court area was an adopted one and hence maintained by the local council at public expenses. It was found that there are no proposals for road improvement or new roads within 200 metres of the premises. However, the internal pathway to the area is not adopted and hence the client may have to contribute towards maintenance. The Conveyancing team contacted the seller’s solicitors Mark Ellis and Co. to enquire about the arrangements. Estate agent for the transaction was Thompson Vales Estate Agents.
