On 27th November 2007, a client hired the Phew! Conveyancing team for assisting him in purchasing a property situated in Couchman house, Poynders Road, London. The property was sold for £ 241500 to the client. The local authority associated with the deal was London Borough of Lambeth.
The team examined the entire official copy entries and found out that the property was leasehold and the title was absolute. This indicated that the Registry guarantees the ownership. The Phew! Conveyancing team also found out that the property was occupied solely by the seller and his immediate family members.
On further enquiry by the team, it was found that there were some additional rights over the property as per the lease dated 19th September 1988. Moreover, some additional restrictive covenants were registered against the property and they are referred in the lease and the freehold title. The Phew! Conveyancing team referred to the restrictive covenants in the charges register to find out whether the property can only be used as a private dwelling. The team also, noted that only the second floor flat was included in the title.
The area where the property stands is subject to Smoke Control Order, according to which smoke from chimneys are prohibited. The Clean Air Act also restricts smoke from other premises.
Another important thing noted by the team was that, the Couchman house area is not an adopted one, which means that the client will have to contribute for maintenance and repair works in this area. There were no plans or proposals for any road improvements or lying of new roads. The internal access ways to the estate was also not adopted.
