On 11th February 2011, the Phew! Conveyancing team was hired by a client for assisting him in purchasing a property located in Hurst Street, London. Ultimately, the property was purchased for £ 370000 by the client. The concerned local authority was London Borough of Lambeth.
All the related official copy entries were examined in detail by the team. It was revealed that the property is freehold with absolute title. So, the ownership is assured by the Registry. The team also confirmed that none other than the seller or his immediate family occupied the property, earlier.. The Phew! Conveyancing team also found that the property was subjected to a lease dated 8th August 1974.
The local authority search information by the team brought to light few more things. Firstly, the area where the property was located is under the preview of Smoke Control order, according to which smoke emission from the chimney was prohibited. Also, the Clear Air Act restricts emission of smoke from other premises as well. Even though the Smoke Control Order was not applicable to domestic bonfires, they could be regarded as a statutory nuisance under certain circumstances.
There was a HMO order and as per this the client has to inform the local council if he intends to share the property with any other parties. The issue was discussed with the client and their doubts were clarified. Later, it was also found out that Hurst Street was an adopted area and it was maintained by the local council at the expense of the public. Moreover, there was no any plan or proposal for improvement of existing roads or building of new roads.
