On 9th August 2011, a client instructed the Phew! Maida Vale Conveyancing solicitor to assist in the purchase of a property located at Burlington Close, Maida Vale, London. The property was bought by the client for £ 395000. The London Borough of Westminster was related to this conveyancing deal.

The conveyancing solicitor inspected the office copy entries related to the leasehold property. The property held an absolute title which eliminated fears of ownership as it was guaranteed by the registry. The solicitor also ensured that the property was solely occupied by the seller and his family members before the sale.  The lease only dealt with the property excluding the air space above and the area below ground level of the property.

The conveyancing team also found that the property was under the purview of Smoke Control Order and Clean air Act. According to the Smoke Control Order, excess smoke from chimney was not allowed and the Clean Air Act did not allow smoke of any kind from other premises, as well.

According to an HMO order, the London Borough of Westminster must be informed, if the property was occupied by more than one family as bed or sitting rooms or any other non self-contained accommodation with sharing facilities. A licence from the London Borough of Westminster was required before the property was let as HMO. Any failure to do so might pave way for legal action.

Burlington Close is adopted & maintained by the London Borough of Westminster. Our conveyancing solicitors’ inspection did not reveal any future plans regarding the arrival of new roads or maintenance of existing roads.
